Настоящая статья посвящена рассмотрению правовых механизмов противодействия коррупционным правонарушениям в сфере государственных и муниципальных закупов, включающих в себя превентивные, процедурные и санкционные средства. Особый акцент в статье сделан на анализе расхождений между законодательными предписаниями и реальной правоприменительной практикой. Автор приходит к выводу о том, что нормативная закрепленность механизмов сама по себе не гарантирует реального снижения уровня коррупции, т.к. коррупционные практики адаптируются к формальным запретам и смещаются в сегменты закупочного цикла, наименее охваченные процедурным контролем.

This article is devoted to the consideration of legal mechanisms for countering corruption offenses in the field of state and municipal procurement, including preventive, procedural and sanctions measures. A special emphasis in the article is placed on the analysis of discrepancies between legislative prescriptions and actual law enforcement practice. The author comes to the conclusion that the regulatory anchoring of the mechanisms by itself does not guarantee a real reduction in the level of corruption, because Corrupt practices adapt to formal prohibitions and shift to the segments of the procurement cycle that are least covered by procedural control.
