В статье исследуются теоретико-правовые аспекты регулирования использования информационных технологий в системе исполнительной власти. Актуальность исследования определена масштабной цифровой трансформацией государственного управления, которое сопровождается внедрением информационных систем, переходом к электронному документообороту, расширением практики межведомственного информационного взаимодействия и развитием цифровых форм предоставления государственных услуг. Рассматриваются особенности нормативно-правового регулирования указанных процессов, а также правовые условия функционирования государственных информационных ресурсов и информационных систем, используемых органами исполнительной власти. Отдельное внимание уделено проблематике обеспечения законности при осуществлении государственного управления с применением информационных инструментов, соблюдению требований в сфере защиты информации и персональных данных, обеспечению информационной безопасности и реализации прав граждан и организаций в рамках электронного взаимодействия с государственными органами. Обосновывается необходимость дальнейшего совершенствования законодательства в рассматриваемой сфере с учётом технологических изменений, принципов правовой определённости и гарантированности прав участников информационного взаимодействия.

This article examines the theoretical and legal aspects of regulating the use of information technologies within the executive branch of government. The relevance of the study is determined by the large-scale digital transformation of public administration, which is accompanied by the implementation of information systems, the transition to electronic document management, the expansion of interagency information exchange, and the development of digital forms of public service delivery. The article considers the specific features of the legal regulation of these processes, as well as the legal conditions governing the functioning of state information resources and information systems used by executive authorities. Particular attention is paid to ensuring legality in public administration through the use of digital tools, compliance with requirements in the field of information and personal data protection, ensuring information security, and safeguarding the rights of citizens and organizations within the framework of electronic interaction with public authorities. The article substantiates the need for further improvement of legislation in this area, taking into account technological developments, the principles of legal certainty, and the protection of the rights of participants in information exchange.
