<p>The article analyzes the legal risks associated with the use of robotic systems in the activities of institutions of the penal system of the Russian Federation (Penal System), with an emphasis on the ongoing doctrinal uncertainty regarding the status of robotics asboth an object and a means of committing a crime, aswell as an infrastructural element mediating the exercise of personnel authority. Particular attention is paid to the enhanced harm‑causing capacity of autonomous robots, aspects related to the combination of software and hardware components, and their impact on crime patterns and the scope of potential harm under conditions of destructive interference including remote control, coordination of multiple devices, and the ability to operate autonomously for extended periods without direct human involvement. It is noted that current legislation does nottreat the use of a robot as a qualifying feature, and the general reference to «specially manufactured technical means» does notcover typical scenarios involving the use of mass‑produced robotics in the commission of crimes, including within penal institutions, where such devices are becoming part of the standard operational infrastructure. The article argues for the need to differentiate criminal liability based on the type of robotic system, the degree of autonomy, the nature of itsofficial use in penal institutions, and the actual extent to which algorithmic decisions contribute to socially dangerous consequences. The principle of retaining substantial human control is introduced as a criterion for the lawfulness of using robotic systems in penitentiary activities and as a basis for allocating responsibility among the operator, the algorithm administrator, and the developer including cases of indirect harm caused by incorrect programming or configuration of an autonomous system. A system of legal restrictions on the deployment of robotics in the activities of the Federal Penitentiary Service of Russia is formulated, encompassing requirements for algorithmic transparency, predictability of autonomous system behavior, technological verifiability of their decisions, and the prevention of situations where nocrime subject exists when substantial harm is caused to public relations protected by criminal law.</p>
<kwd-group xml:lang="ru"><kwd>уголовно-исполнительная система Российской Федерации</kwd><kwd>ФСИН России</kwd><kwd>робототехническая система</kwd><kwd>автономная интеллектуальная система</kwd><kwd>искусственный интеллект</kwd><kwd>уголовно-правовые риски</kwd><kwd>повышенная причиняющая способность</kwd><kwd>алгоритмическая прозрачность</kwd><kwd>человеческий контроль</kwd><kwd>квалифицированный состав преступления</kwd><kwd>пенитенциарная безопасность</kwd><kwd>дифференциация ответственности</kwd><kwd>правовые ограничения</kwd><kwd>средства совершения преступления</kwd><kwd>цифровизация</kwd></kwd-group><kwd-group xml:lang="en"><kwd>Penal system of the Russian Federation</kwd><kwd>Federal Penitentiary Service of Russia</kwd><kwd>robotic system</kwd><kwd>autonomous intelligent system</kwd><kwd>artificial intelligence</kwd><kwd>criminal lawrisks</kwd><kwd>enhanced harm-causing capacity</kwd><kwd>algorithmic transparency</kwd><kwd>human control</kwd><kwd>qualified crime elements</kwd><kwd>penitentiary security</kwd><kwd>differentiation of liability</kwd><kwd>legal restrictions</kwd><kwd>means of committing a crime</kwd><kwd>digitalization</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Денисенко О.
