В статье рассматриваются актуальные проблемы наследования цифровых активов в условиях стремительного развития цифровизации, существующие препятствия, мешающие определению и подтверждению прав на цифровые активы: анонимность криптовалютных кошельков и закрытость данных внутри технологических платформ. Большое внимание уделяется основному механизму передачи наследственных прав – «Цифровому нотариату». В работе предлагается внедрение технологии блокчейн и специальных IT‑программ (далее - API), что позволит в дальнейшем нотариальным органам получить доступ к цифровым следам наследодателя и сформировать опись всего цифрового имущества.

The article discusses the current problems of digital asset inheritance in the context of the rapid development of digitalization, the existing obstacles preventing the definition and confirmation of rights to digital assets.: anonymity of cryptocurrency wallets and privacy of data within technology platforms. Much attention is paid to the main mechanism of transfer of inheritance rights – the "Digital Notary". The paper proposes the introduction of blockchain technology and special IT programs (hereinafter referred to as APIs), which will further allow notary authorities to gain access to the testator's digital footprints and create an inventory of all digital property.
