<p>This article examines the current regulation of cross-border data transfer in India, taking into account the specifics of the banking sector. Itanalyzes the main administrative and legal sources, such as the general and fundamental source, The Digital Personal Data Protection Act; the secondary legislation detailing the regulation, The Digital Personal Data Protection Rules; and the regulations of the Reserve Bank of India, which are of particular importance in regulating data transfer in the banking sector due to the direct reference to this regulations in the DPDP Act. These sources form the basis for legal regulation of cross-border data transfer procedures and establish the specific status of banks asentities responsible for processing particularly sensitive data. A number of problems with the existing regulatory system are noted, namely, on the onehand, flexibility and adaptability to changing political conditions and international security; on the other hand, a lack of stability, excessive government powers in terms of adopting secondary legislation on a number of crucial regulatory issues, and insufficient specificity of the regulations, despite the adoption of detailed rules. The article also highlights keyfeatures of India’s existing data protection regime, including the use of a “negative list” approach, a focus on digital data, and the introduction of a designated entity for sensitive data. This suggests the existence of a foundation for developing a unique regulatory mechanism for cross-border data transfers that, while taking into account the specifics of the banking sector, ensures a high standard of protection and grants banks broad discretion when arranging data transfers to foreign jurisdictions.</p>
<kwd-group xml:lang="ru"><kwd>трансграничная передача данных</kwd><kwd>банки</kwd><kwd>режим защиты данных</kwd><kwd>персональные данные</kwd></kwd-group><kwd-group xml:lang="en"><kwd>cross-border data transfer</kwd><kwd>banks</kwd><kwd>data protection regime</kwd><kwd>personal data</kwd><kwd>DPDP Act</kwd><kwd>DPDP Rules</kwd><kwd>Reserve Bank of India</kwd><kwd>Republic of India</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Ganga V.
