<p>The article is devoted to the analysis of legal conflicts arising from the formation of digital penitentiary infrastructure in institutions of the Federal Penitentiary Service of Russia in connection with the implementation of intelligent audio analytics systems capable of recording and interpreting in real time the speech behavior of convicts and other individuals. The study focuses on the correlation between the technological capabilities of automated speech analysis, acoustic events, and psycho-emotional parameters of vocal behavior with the requirements of current legislation regulating the use of technical means of supervision. Special attention is paid to the qualitative change in the criminogenic situation in penitentiary institutions, caused by the high number of convicts for terrorist and extremist crimes, a significant proportion of foreign citizens and persons with mental disorders, which actualizes the need for predictive security tools, asnoted in contemporary research on audio analytics and digital technologies. The potential advantages of audio analytics are highlighted, such asearly conflict detection, monitoring of emotional tension, overcoming the language barrier in supervising foreign citizens, aswell as the associated risks, from arbitrary interference in the sphere of private life and freedom of communication to the legal uncertainty of the status of data obtained from speech analysis. The compliance of existing artificial intelligence-based solutions with constitutional principles and norms of penal enforcement law is analyzed, considering the specifics of penitentiary institutions where speech behavior simultaneously acts as an object of the right to communication and an indicator of the operational situation. Based on doctrinal analysis, the author’s gradation of audio information by levels of interference in private life is proposed, and a system of legal principles (presumption of legality, purpose limitation, exceptionality and judicial control, verification and transparency) is formulated, subject to enshrinement in penal enforcement legislation. The necessity of amending regulatory legal acts aimed at legalizing audio analytics while simultaneously strengthening human rights guarantees and clarifying the responsibility of officials for interpreting digital data is substantiated. The proposed measures serve to implement the “from law to technology” model, in which technological solutions are initially designed to meet the requirements of the principles of proportionality, necessity, and minimal interference, which allows harmonizing technological innovations with legal norms and minimizing the risks of violating the rights of convicts in the context of digital transformation of the penal system of the Russian Federation.</p>
<kwd-group xml:lang="ru"><kwd>искусственный интеллект</kwd><kwd>аудиоаналитика</kwd><kwd>уголовно-исполнительная система Российской Федерации</kwd><kwd>технические средства охраны и надзора</kwd><kwd>предиктивная аналитика</kwd><kwd>биометрические данные</kwd><kwd>пенитенциарная безопасность</kwd><kwd>правовые принципы</kwd><kwd>многоязычие</kwd><kwd>цифровая трансформация</kwd><kwd>верификация данных</kwd></kwd-group><kwd-group xml:lang="en"><kwd>artificial intelligence</kwd><kwd>audio analytics</kwd><kwd>penal system of the Russian Federation</kwd><kwd>technical means of security and supervision</kwd><kwd>predictive analytics</kwd><kwd>biometric data</kwd><kwd>penitentiary security</kwd><kwd>legal principles</kwd><kwd>multilingualism</kwd><kwd>digital transformation</kwd><kwd>data verification</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Денисенко О.
