В статье проанализирована нормативная база, регулирующая третейское разбирательство между пациентами и клиниками пластической хирургии. Особое внимание уделяется проблемам допустимости передачи медицинских споров в третейские суды, вопросам действительности третейских оговорок, процессуальным гарантиям сторон и практике взаимодействия третейских судов с судами общей юрисдикции на стадии признания и приведения решений в исполнение. Делается вывод о потенциале третейского разбирательства как альтернативного способа разрешения конфликтов в сфере пластической хирургии при условии строгого соблюдения принципов добровольности, информированного согласия пациента и баланса интересов сторон.

The article analyzes the regulatory framework governing arbitration between patients and plastic surgery clinics. Special attention is paid to the issues of the admissibility of the transfer of medical disputes to arbitration courts, the validity of arbitration clauses, the procedural guarantees of the parties and the practice of interaction of arbitration courts with courts of general jurisdiction at the stage of recognition and enforcement of decisions. The conclusion is made about the potential of arbitration as an alternative way to resolve conflicts in the field of plastic surgery, subject to strict adherence to the principles of voluntariness, informed consent of the patient and a balance of interests of the parties.
