<p>The article examines approaches to the legal protection of digital rights and copyright in the digital environment in Russia, the United States, and France (aspart of European Union law). Itdemonstrates that the Russian model is characterized by the normative autonomization of “digital rights” as a civil-lawcategory exercised in accordance with the rules of an information sys tem, whereas the U.S. legal order follows a sector-specific (fragmented) regulatory design without a single statutory definition of “digital rights.” The French approach, rooted in the tradition of droit d’auteur (authors’ rights), combines copyright protection of digital works with the EU-wide frame work for personal data protection under the GDPR, thereby forming a dual-channel model for safe guarding digital interests. Special attention is paid to authorship in the context of the spread of generative artificial intelligence: the paper substantiates the thesis that the jurisdictions considered converge in recognizing human authorship as a basic condition for the emergence of copyright protection. - - DOI: 10.24412/2782-3830-2026-1-77-81 № 1 - 2026 78 The article concludes that rightsholders and participants in digital markets should take into account differences in legal techniques (codification, technological prohibitions, moral rights, and data-protection regimes) when developing a cross-border strategy for rights protection.</p>
<kwd-group xml:lang="ru"><kwd>Цифровые права</kwd><kwd>авторское право</kwd><kwd>цифровая среда</kwd><kwd>сравнительное правоведение</kwd><kwd>информационная система</kwd><kwd>моральные права</kwd><kwd>искусственный интеллект</kwd></kwd-group><kwd-group xml:lang="en"><kwd>Digital rights</kwd><kwd>copyright</kwd><kwd>digital environment</kwd><kwd>comparative law</kwd><kwd>DMCA</kwd><kwd>droit d’auteur</kwd><kwd>GDPR</kwd><kwd>information system</kwd><kwd>moral rights</kwd><kwd>artificial intelligence</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="en">Berne Convention for the Protection of Liter ary and Artistic Works from 09.09.1886 https://docs. cntd.ru/document/1900493</mixed-citation><mixed-citation publication-type="other" xml:lang="ru">Бернская Конвенция по охране литера турных и художественных произведений от 09.09.1886 https://docs.cntd.ru/document/1900493</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="en">Civil Code of the Russian Federation (part four): federal law of 18.12.2006 N 230-FZ (asamended on 01.07.2017) //Collection of legislation of the Russian Federation. — 2006. - N 52 (1 hour). — 2006. — N 52 (1 ч.). - Ст. 5496</mixed-citation></ref><ref id="ref3"><mixed-citation publication-type="other" xml:lang="en">Digital Millenium Copyright acthttps://www. copyright.gov/legislation/dmca.pdf</mixed-citation><mixed-citation publication-type="other" xml:lang="ru">Digital Millenium Copyright acthttps://www. copyright.gov/legislation/dmca.pdf</mixed-citation></ref><ref id="ref4"><mixed-citation publication-type="other" xml:lang="en">Code de lapropriйtй intellectuelle https:// codes.droit.org/PDF/Code%20de%20la%20pro pri%C3%A9t%C3%A9%20intellectuelle.pdf 5.
