Статья посвящена актуальным теоретическим проблемам, связанным с созданием специализированных административных судов в Российской Федерации. Несмотря на конституционное закрепление административного судопроизводства и десятилетний опыт действия КАС РФ, организационное оформление административной юстиции остается незавершенным. В работе анализируются основные доктринальные противоречия, препятствующие реформированию судебной системы: отсутствие единого подхода к пониманию административного процесса, дискуссионность выбора модели административных судов, проблема разграничения компетенции, а также сложности институциональной интеграции новых судов в существующую систему. Особое внимание уделяется анализу мнений ведущих ученых-административистов, исследовавших данную проблему. На основе изучения теоретических наработок и зарубежного опыта предлагаются возможные пути решения выявленных проблем с акцентом на поэтапное и доктринально обоснованное реформирование.

The article is devoted to the current theoretical problems associated with the creation of specialized administrative courts in the Russian Federation. Despite the constitutional consolidation of administrative proceedings and the ten-year experience of the CAS RF, the organizational formation of administrative justice remains incomplete. The paper analyzes the main doctrinal contradictions that impede the reform of the judicial system: the lack of a unified approach to understanding the administrative process, the debatable choice of the model of administrative DOI: 10.24412/2782-3830-2026-2-124-128 courts, the problem of delimitation of competence, aswell as the difficulties of institutional integration of newcourts into the existing system. Special attention is paid to the analysis of the opinions of leading administrative scientists whohave studied this problem. Based on the study of theoretical developments and foreign experience, possible ways to solve the identified problems are proposed, focusing on a phased and doctrinally sound reform.
