Методологическую основу составили формально-юридический, сравнительно-правовой и системный методы, а также анализ законодательства, арбитражных регламентов, профессиональных стандартов и судебной практики Англии и Уэльса, Австралии, США, Сингапура и Гонконга. Установлено, что при различии национальных форм регулирования их функциональное ядро сближается. Обоснована смешанная модель, в которой «мягкое» право формирует первичные стандарты, арбитражные регламенты придают им процессуальное действие, практика проверяет их применимость, а точечные нормы «жесткого» права закрепляют минимальные гарантии допустимости финансирования, раскрытия информации и автономии сторон. Предложены направления поэтапной адаптации модели для России и Евразийского региона без преждевременной всеобъемлющей кодификации.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The purpose of this article is to identify a regulatory model for third-party funding that accommodates the transnational nature of international arbitration, the economics of dispute funding, and procedural fairness. The research employs doctrinal, comparative, and systemic methods and examines legislation, arbitral rules, professional standards, and case law in England and Wales, Australia, the United States, Singapore, and Hong Kong. The analysis shows that, despite different national regulatory forms, their functional core is converging. The article substantiates a hybrid model in which soft law sets primary standards, arbitral rules give them procedural effect, practice tests their application, and targeted hard law secures minimum guarantees of permissibility, disclosure, and party autonomy.
