<p>CRISPR-Cas-based genome editing technologies have formed a newtype of in tellectual property: it is both a fundamental research platform, a set of applied techniques for various biological systems and a basis for the development of medicinal products, including exvivo approaches that have already received regulatory approval. At the same time, the legal protection of CRISPR in world practice hasbecome notjust a tool for stimulating innovation, but a factor affecting the structure of markets, access to licensing, the speed of translating research into the clinic and the distribution of benefits between universities, startups and pharmaceutical companies. The “patent wars” around CRISPR-Cas9 showed that in the conditions of high commercial value of platform technology, traditional criteria for patentability and procedures for establishing priority turn into a mechanism for competition, and notjust legal fixation of novelty. The international nature of research and development chains creates additional complexity: patent portfolios are formed in parallel in different jurisdictions, and decisions of patent offices and courts candiverge, creating legal frag mentation. Against this background, an analysis of international genomic editing rights practices is needed to understand exactly howlegal regimes stimulate or deter the development and implemen tation of therapeutic and research applications of CRISPR, aswell aswhich models balance the in terests of copyright holders and public interests in health and science.</p>
<kwd-group xml:lang="ru"><kwd>редактирование генома</kwd><kwd>патентоспособность</kwd><kwd>изобре тательский уровень</kwd><kwd>объём правовой охраны</kwd><kwd>патентные семейства</kwd><kwd>лицензирование</kwd><kwd>патент ныепулы</kwd><kwd>исследовательское исключение</kwd><kwd>принудительное лицензирование</kwd><kwd>университет ские патенты</kwd><kwd>биотехнологические изобретения</kwd></kwd-group><kwd-group xml:lang="en"><kwd>CRISPR-Cas9</kwd><kwd>genome editing</kwd><kwd>patentability</kwd><kwd>inventive level</kwd><kwd>scope of legal protection</kwd><kwd>patent families</kwd><kwd>licensing</kwd><kwd>patent pools</kwd><kwd>research exclusion</kwd><kwd>compulsory licensing.
